Aivident Terms of Service

By accessing or using the Aivident AI Recruitment Platform ("Platform"), operated by PT While True Lab ("WTL", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all users, including Candidates (interviewees), Recruiters (enterprise users), and Website Visitors.

You must be at least 17 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 17 years old.

These Terms are available in English and Bahasa Indonesia. In the event of any discrepancy between the English and Bahasa Indonesia versions, the Bahasa Indonesia version shall prevail for users in Indonesia.

Aivident provides AI-powered recruitment interview and assessment services. The Platform enables enterprise clients ("Recruiters") to conduct structured, AI-assisted interviews with job candidates ("Candidates").

Key features include:

• AI-generated interview questions based on job requirements and candidate CVs
• Real-time conversational AI interviews (voice and/or text)
• Speech-to-text transcription of candidate responses
• AI-generated competency assessments and scoring
• Assessment reports for Recruiter review

Recruiters must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You agree to: (a) provide accurate and complete registration information; (b) maintain and promptly update your information; (c) notify us immediately of any unauthorized use of your account; (d) not share your account credentials with unauthorized persons.

Candidates access the Platform via interview links provided by Recruiters. Before participating in an AI-assisted interview, Candidates must:

• Read and acknowledge the Privacy Notice
• Consent to AI-assisted interview processing, including audio recording and transcription
• Consent to data retention as described in the Privacy Notice
• Candidates may withdraw consent at any time by contacting [email protected]

AI-generated assessments, scores, and recommendations are advisory only. They are tools to assist Recruiters in evaluating candidates, not definitive judgments.

WTL does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated assessment. Final hiring decisions are the sole responsibility of the Recruiter.

Aivident does not engage in automated decision-making that produces legal effects or similarly significant effects on Candidates (per Article 22, UU PDP).

We process personal data in accordance with our Privacy Notice (available at aivident.io/privacy) and applicable data protection laws, including Indonesian Law No. 27 of 2022 on Personal Data Protection (UU PDP).

For enterprise clients: WTL acts as a Processor on your behalf. Data processing is governed by the Data Processing Agreement (DPA) between you and WTL.

For Candidates: your data is processed as instructed by the Recruiter (Controller). Your data protection rights are described in our Privacy Notice.

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to the Platform or other users' data
• Interfere with or disrupt the Platform's infrastructure
• Use automated tools (bots, scrapers) to access the Platform without written permission
• Upload malicious content, viruses, or harmful code
• Impersonate another person or entity
• Use candidate data for purposes other than recruitment evaluation
• Share candidate data between different enterprise clients (tenant isolation is enforced)

The Platform, including its software, design, logos, and documentation, is the intellectual property of PT While True Lab. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written consent.

Content generated by the AI (interview questions, assessments) is provided as part of the service. Recruiters may use AI-generated assessment reports for their internal recruitment purposes.

Candidate-provided content (CVs, interview responses) remains the property of the respective Candidate.

We strive to maintain Platform availability but do not guarantee uninterrupted or error-free service. We may temporarily suspend access for maintenance, updates, or security reasons.

We will make reasonable efforts to provide advance notice of planned downtime to enterprise clients.

To the maximum extent permitted by applicable law, WTL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

WTL's total aggregate liability for any claims related to the Platform shall not exceed the fees paid by you in the twelve (12) months preceding the claim, unless otherwise governed by a separate enterprise agreement.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud; (c) any liability that cannot be excluded by law.

You agree to indemnify and hold harmless WTL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of the Platform; (c) your violation of any third-party rights.

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason with reasonable notice.

Enterprise clients: termination is governed by the main service agreement. Data retention and deletion after termination follows our Data Retention Policy and any applicable DPA.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 10, 11, and 13) shall survive.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

Any dispute arising out of or in connection with these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the jurisdiction of the courts of Jakarta, Indonesia, unless otherwise agreed in a separate enterprise agreement.

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will notify enterprise clients via email at least 14 days before the new terms take effect.

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
